NOVATO, Calif. (KGO) -- A good way to get a good deal on filling up your tank could be coming to an end. A Bay Area judge is ordering Safeway to raise its pump prices. The Safeway gas station on Nave Drive is typically very busy. Drivers usually have to wait in line to get an open pump. It's no surprise why: prices here are typically less expensive than what you might find at other gas stations and if you have a Safeway Club Card, it's even 3 cents cheaper. And if you buy groceries, there's even more savings -- 10 cents off per gallon for every $100 spent inside their store.

Back in the early days, one cornering the market could run the competition out of business by selling below cost. Certainly, there are no gas retailers with such a corner, so the whole notion is rather silly. Now, to be in government is to follow rules, blindly, mostly devoid of common sense, be it an activist judge or bureaucrat, which is why we could slash those in public dis-service in half and still be over regulated.

According to the Kroger website, its gas discounts are "Not valid in AL, LA, MO or where prohibited by law," so it's not just California that has these crazy laws.

So instead of actually 'competing' by offering a better product or a lower price they run crying to the government to make things 'fair'. Then they turn around and try to call it competition. In the end it's the consumer who loses, not the attorneys, not the stores and certainly not the government.

does this law mean that one store can't sell an item as a loss leader
to attract customers?
it's done all the time by grocery stores.
gasoline bonus points are just another loss leader.

Yeah, what happened to free trade? Others sure are free to raise gas prices, why can't Safeway sell it as cheap as they want? If they want to LOSE money on gas, that's their business (and our good fortune).

Interesting. Shell/QFC/Fred Meyer/(Kroger), Safeway, Costco, and a lesser extent in this area Albertsons all do it.

this just seems wrong... Don't all businesses sell items at or below cost with the intent to make their money on other items? Let's talk printers. Most are sold at cost with the plan to make their money on all the ink. Seems like a standard practice.

The article says it is illegal to see gas under cost. I wonder how that law came into existance?

That's the spirit, too low on price so they are ordered to increase the price by a Judge.
